		TERMS OF SERVICE INTRODUCTION: In this Service Agreement henceforth referred to as ("agreement"), the individual, individuals or entity henceforth referred to in this agreement as (client.) and Coastal Artwork. hence forth in this agreement referred to as (agent) " agree to the following obligations and terms. This Agreement explains our obligations to you, and your obligations to us, in relation to your use of our service(s). By accessing this site in any way, ordering products listed on it and/or utilizing agent service(s), you agree to the terms and conditions set forth in this Agreement. This Agreement supersedes all prior agreements you may have with Agent and is subject to change with revised versions being posted on the coastalartwork.com website which at such time would supersede the previous version. If changes made are deemed unacceptable by you the client, your account with us the agent may be canceled in writing. Said cancellation confirmation must be received within 10 days (verified by U.S postmark or verifiable email time stamp) of said change. At such point, no further obligation will be passed on to client to pay for services rendered from the date of said agreement changes, to the date of resolution. Agent should in no way be considered the seller but merely a way for the seller to advertise their goods. We in no way back, endorse, recommend or guarantee any client or their goods, which may in any way, be found within agent site(s) or services or linked to its site(s) services in any way. ACCURATE INFORMATION: This section shall survive the completion, expiration, termination or cancellation of this agreement. In entering into Agreement for services with agent, client agrees that all information provided is true and accurate. Client further agrees they are the rightful sole owner of the goods they provide, advertise, sell. Client shall otherwise have all required legal permissions, certificates, licenses or other necessary documents to provide, advertise or sell on behalf of the rightful owner(s) and that no item listed could in any way be considered stolen or a forgery. Client agrees to in no way misrepresent his goods for sale by giving an inaccurate description and may in no way compare goods for sale to any name brand including but not limited to misspellings of any name brand. Agent admits and client understands and agrees that the occasional error, omission and misplacement in our services may occur and will be corrected upon notification by the client or realization of such by our staff. Any possible resulting harm from such is speculative in nature and agent assumes no responsibility other than as contained in these terms and conditions. Client hereby agrees to indemnify, defend and hold harmless the agent, as well as its officers, directors, agents, affiliates, distributors, franchises and employees against all claims, actions, liabilities, losses, expenses, damages and costs (including without limitation, attorneys' fees that may at any time be incurred as a result of any claims, suits or proceedings for libel, defamation, violation of right of privacy or publicity, copyright infringement, trademark infringement or other infringement of any third party right, fraud, false advertising, misrepresentation, product liability or violation of any law, statute, ordinance, rule or regulation) throughout the world in connection with the advertisement(s) or clients content which may arise out of any material breach by client of any duty, representation or warranty under this Agreement. PROMOTIONAL OFFERS: If you are given a free promotional service offer ie, 30 day free trial and would like your services to continue after the promotional date has expired, Full Monthly Service Fees including any possible setup fees for the up and coming month must be received 5 days prior to the expiration of your promotional offer. Any fees not received in this time frame will be considered an indication to us that you do not wish to continue utilizing our services and the content will be pulled down. FEES, PAYMENTS FROM CLIENT TO AGENT: As consideration for the services client has chosen, the Client agrees to pay Agent applicable service(s) fees set by Agent in accordance with the service(s) provided. All fees are due upon activation of the service(s), and are non-refundable. Any refunds given will be at the discretion of Agent. Payment is due upon receipt of invoice. Any invoice balance not received 30 days from invoice date will acquire a late fee of 2% on said balance. Client understands that all charges are considered valid and any dispute of charges must be received in writing no more than 30 days from invoice date. If client chooses to take advantage of any prepayment plans or promotions, it is understood and agreed by client that said payment would be non-refundable. If client chooses to be invoiced, client agrees to make payment within 30-days of invoice and agrees to pay all applicable fees. Any returned or declined payments will receive a 25.00 NSF fee. Client further agrees to pay any and all collection and or attorney fees, which may arise due to a failure to pay for services. Agent can currently accept payments in the form of cash or check drawn from a United States bank account, or money order, payable in U.S. dollars. FEES, PAYMENTS BETWEEN CLIENT AND BUYERS: Under this agreement, buyer and seller fully understand that all transactions are strictly between buyer, seller and any chosen third party merchant. Coastal Artwork can not and does not provide buyer or seller with any form of merchant account and is strictly provided as a means for artist to advertise their goods for sale. Coastal Artwork is committed to the banning of any seller or buyer with a less than reputable history, within reason, according to any possible complaints concerning that individual we may receive. Client is prohibited from charging any additional fees for normal forms of payment to buyers of their goods, which were a direct or indirect result of services provided by agent. This with the services offered by agent Sellers may in no way charge the buyer additional fees for normal forms of payment. This includes but is not limited to personal checks, money orders, credit or debit cards and the like. Seller must indicate the true dollar amount expected up-front as well as its excepted, acceptable, currency type i.e., U.S., Canadian, European, etc. Fees to exchange currency may be handed down to the buyer so long as the buyer is made aware and has acknowledged such in writing before final transaction between client and buyer occurs. As a Coastal Artwork buyer and/or seller, you accept full liability for buying or selling within the legal limits of the law, whether it be it in your state/region of residence, the state/region in which you are present at the time of purchase, or the state/region in which the seller holds legal residency and/or where their goods are located at the time of sale. Items prohibited from being sold via our site are any items that can in no way be deemed as art, pirated goods of any kind, be it intentional or through ignorance or forgeries of any kind. COASTAL ARTWORK TERMS AND CONDITIONS AGREEMENT CONTENT / SERVICE CHANGE REQUEST: Client request for changes to content (including detection of errors) or current services are required in writing and must be received 10 business days prior to the date in which the update or change should take place. Agent will do everything in its power to make said request occur at the earliest possible date prior to the required time frame but makes no guarantee of such, be it expressed or implied. Agent is in no way liable for any consequences resulting from client's failure to provide updated, complete, or accurate information. CANCELLATION / CONTRACT RENEWAL: Agent will renew Client services automatically for a renewal contract period of 12 months unless formal written cancellation is received no more than 10 business days after client contract expiration or service(s) anniversary date. Said contract renewal will continue indefinitely or until such time as contract is terminated by either party under the conditions set forth in this agreement. All subscription services are billed at the beginning of the subscription term. TIME IS OF THE ESSENCE: All goods sold as a result of this sight should be shipped to buyer 15 days from written confirmation of purchase unless otherwise agreed upon between buyer and seller in writing be it more or less. CONFIDENTIALITY: Any information obtained as a result of utilizing this site is considered private and can in no way be divulged to a third party for any reason, other than to a legitimate registered collection agency for the sole purpose of collecting unpaid money due as a result of a sale in connection with the utilization of this site or to the proper authorities as a result of finding illegally sold or forged goods. Any indication that such an act has occurred will be grounds for immediate termination of services and will result in notification to the proper authorities. Your privacy is Very important to us. Agent vows to protect your information to the very best of our abilities and will in no way sell your information to a third party. COPYRIGHTS: Client agrees that Agent is the author of the advertising prepared posted and or distributed as a result of the services it provides. This includes but is not limited to any derivative work prepared from client advertising. Agent retains all titles, rights and interest, including related copyright, in the same manner. Client is required to obtain prior written consent from agent before reproducing agents copyrighted work, name or marks, which includes offering same to a third party for the same intent. FAMILY SAFE CLAUSE: This site and its corresponding services are intended to be family safe and will not accept any vulgarities or pornographic materials in its content. Links may in no way lead to questionable or pornographic sites and should only lead to further information related to the goods for sale. RIGHT OF REFUSAL: Agent reserves the right, in its sole discretion, to refuse or deactivate any services it may provide without notification. By agreeing to this agreement, client verifies they are at least 21 years of age or older and has read, understands and fully agrees to and will abide by the terms and conditions within.
